THE RIGHT OF NATIVE HAWAIIANS AS INDIGENOUS PEOPLES TO SELF-DETERMINATION UNDER INTERNATIONAL HUMAN RIGHTS LAW AND U..S.. DOMESTIC LAW

International human rights laws and norms, in particular, the right of self-determination, are relevant to the status and rights of Native Hawaiians. However, many of these powerful theories are not fully understood or utilized on the front lines of the political and legal debate. Join us as we hear from Indigenous rights scholars and advocates, who will outline and discuss the rights of Native Hawaiians to self-determination under international human rights law as well as under domestic U.S. law. Using the lens of international law and norms, speakers will assess and examine current and future Native Hawaiian self-governance efforts, and suggest paths for the future.

Featured Speakers:

Mililani Trask, Esq., Native Hawaiian attorney, former Pacific representative to the United Nations Permanent Forum on Indigenous Issues, and an indigenous expert to the United Nations in international and human rights law.

Rebecca Tsosie, Esq., legal scholar and author, the Executive Director of the Indian Legal Program at Arizona State University School of Law, and Supreme Court Justice for the Fort McDowell Yavapai Nation.

Esther Kia‘ina, Esq., has lived in Washington, D.C. for the past 20 years, spending the majority of her career on Capitol Hill developing an expertise in Native Hawaiian issues and the U.S. Pacific Islands, with a special emphasis on political status and land claims. Key legislation she has worked on include the Apology Resolution, the Hawaiian Home Lands Recovery Act, the Guam Excess Lands Act, and the Guam Land Return Act.
