Ruling favors KS; 9th Circuit hearing audio

Star-Bulletin reports:
The non-Hawaiian boy who has challenged Kamehameha Schools' "Hawaiians-only" admission policy has lost another legal shot at attending the private school for his senior year.

Late yesterday, the 9th Circuit Court of Appeals denied a motion made this week by attorneys for the unidentified student, referred to as "John Doe," asking that the case be transferred back down to the U.S. District Court in Hawaii on an emergency basis so that the boy can ask the court to force Kamehameha to admit him pending the outcome of an expected lengthy appeals process.

The article has info about the process of seeking an "en banc" hearing and insight into the KS strategy. The Advertiser article has more.

Several KS related letters in the Advertiser, and in the Star-Bulletin letters Richard Pomaikaiokalani Kinney says:
Only through the revival of the government of the Hawaiian kingdom will Kamehameha Schools and Hawaiians be safe from vicious attacks.

And a good find from Ian Lind:
If you're looking for more insight into the 9th Circuit Court's recent Kamehameha Schools' decision, here's a little known resource: an audio recording of the oral arguments is available online. Click here to reach the 9th Circuit web site, select the "Audio Files" button at the top left, and then enter the Kamehameha case number (04-15044) when the search box appears. The download is just over 8 megabytes, so if you've got a dial-up connection, you may have a long wait.

I just ran into these audio recordings yesterday while searching for something else. They are quite good quality, and the questioning of attorneys by judges is quite interesting.

Update: Cynthia Oi had a column in Wednesday's Star-Bulletin about justice vs. righteousness in the context of this case, and Doug at Poinography offers his thoughts on it (from the icy arctic).
