OHA suit rehearing request; Hawaiian programs constitutionality

reports:A group of Hawai'i taxpayers yesterday asked the 9th U. S. Circuit Court of Appeals to reconsider a ruling that threw out most of the taxpayers' lawsuit challenging the constitutionality of government funding for the Office of Hawaiian Affairs and the Department of Hawaiian Home Lands.
The group is asking for a rehearing by the three-member panel that issued the ruling or for a rehearing by a larger panel of 11 appeals judges.
Meanwhile,
the Star-Bulletin
reports
that "The Justice Department and the White House continue to raise questions
about the constitutionality of federal programs to help native
Hawaiians."Update:
Doug, curious about the fact that this came up in the context of a military
spending bill, has
more on this article, inquiring about what DOD funds go for Native
Hawaiians. I believe that there is a procurement provision relating to qualified
Native Hawaiian owned concerns being sole source (no competitive bid)
contractors for the DOD.
