Arakaki case against OHA pau
Star-Bulletin
reports:Sixteen taxpayers who challenged the constitutionality of state funding of the Office of Hawaiian Affairs had no standing to bring their claims, a federal judge has ruled.
U.S. District Judge Susan Mollway's order Monday in the long-running Arakaki v. Lingle case brings to an end the lawsuit that initially began in March 2002 as Arakaki v. Cayetano, said Sherry Broder, one of three attorneys representing the state.
While
there is one final filing that the plaintiffs will make by the end of the month,
Mollway has already indicated it will be denied, and then the case will be
dismissed. But no doubt the Arakaki
crowd will resurrect their attack in another form and file a new suit in a way
that tries to overcomes the question of
standing.Update 3/19:
Advertiser
has the AP story,
calling it "a major legal victory" for OHA.
