Kamehameha wins first case


The Advertiser reports: "With a federal court victory on its admission policy fresh in hand, Kamehameha Schools will be back in court today to face an almost identical challenge to the policy that gives preference to Hawaiians. U.S. District Judge Alan Kay yesterday ruled that the school's publicly stated policy of giving admissions preference to applicants who have at least some Hawaiian blood does not violate a section of federal law that prohibits racial discrimination in contractual matters."

Star-Bulletin's story: "A federal judge has upheld the Kamehameha Schools' century-old admission policy, saying the 'race-conscious' policy has the legitimate purpose of addressing economic woes and past injustices suffered by Hawaiians."

The San Francisco Chronicle has picked up the story from the Associate Press, as has CNN. "A federal judge ruled Monday that Kamehameha Schools may continue its native Hawaiians-only admissions policy because of its unique and historical circumstances. U.S. District Judge Alan Kay noted that Kamehameha receives no federal funding, and because of that, the private school isn't held to the same scrutiny as public schools."

Pacific Business News reports on the story, and UH's Ka Leo O Hawaii paper covers it as well.

Reactions in the Hawaiian community.

But the Advertiser editorial warns that "Yesterday's federal court ruling upholding Kamehameha Schools' Hawaiian 'preference' admission policy is far from the end of this story. Both sides anticipated appeals, no matter which way the ruling went. In fact, it is likely that this case (along with a similar one being heard today before Judge David Ezra) will eventually end up before the U.S. Supreme Court."
