Reece injunction rejected - Gallery allowed to show hula portrait
When the controversy over the stained-glass piece
by Marylee Leialoha Colucci of the "Ike" hula pose that is similar to a Kim
Taylor Reece photo first
erupted, there was quite a discussion
here, so I thought folks would be interested in this

article
(also reported
in the
Star-Bulletin)
reporting that Reece has been denied a preliminary injunction, so the gallery
can continue to display the Colucci piece while the larger case continues. Reece
claims that his copyright has been violated, while Colucci claims that Reece can
copyright his photo, but not the hula move itself. Colucci's attorney says this
is an indication of the weakness of Reece's case, while Reece also still
expresses confidence that larger case will go his
way.I have to comment on Reece's quote
at the end: "This is equivalent to me singing a Cazimero song and saying this is
mine because I sang it, and I own it." To me, it seems more like you singing an
ancient traditional chant and claiming that it is yours because you sang it, and
you own it.
