Roberts a Feddie after all?
After initially asking "why were
there conservative Federalist Society lawyers arguing
both
sides" of Rice v. Cayetano, I then noted last week that
the rumors of Supreme Court nominee John G. Roberts Jr. being a member of the
Federalist Society were reported as being
false.But now it turns out that maybe
he was a member after all. The
Washington
Post again
reports
today that Roberts "has repeatedly said that he has no memory of belonging to
the Federalist Society, but his name appears in the influential, conservative
legal organization's 1997-1998 leadership directory."
Roberts is one of 19 steering
committee members listed in the directory, and in that same year's directory,
the article says, "former U.S. solicitor general Theodore B. Olson, is listed as
president of the chapter." Olsen was
of course the one who argued for Rice, opposite Roberts who as arguing for the
state, before the Supreme Court in Rice v. Cayetano just two years
later.
